1. Who we are
Intendity (the "Service", "we", "us") is operated by the Intendity team. By creating an account or otherwise using the Service, you agree to be bound by these Terms & Conditions ("Terms"). If you are entering into these Terms on behalf of an organization, you represent that you have authority to bind that organization.
2. The Service
Intendity is an AI search optimization platform that monitors how generative AI assistants — including ChatGPT, Claude, Gemini and Perplexity — describe brands. The Service is provided as a software-as-a-service offering and is delivered on an "as available" basis.
3. Accounts
3.1 Eligibility
You must be at least 18 years old, or the age of legal majority in your jurisdiction, to use the Service. The Service is intended for business use.
3.2 Account security
You are responsible for keeping your credentials confidential and for all activity that occurs under your account. Notify us immediately of any unauthorized access at [email protected].
3.3 Accuracy
You agree to provide accurate, current and complete information during registration and to keep it updated.
4. Acceptable use
You agree not to:
- use the Service to violate any applicable law or third-party rights;
- reverse engineer, decompile, or attempt to extract source code, except where this restriction is prohibited by law;
- resell, sublicense or commercially exploit the Service without our written consent;
- use the Service to send spam, distribute malware, or interfere with the Service's integrity;
- scrape, mass-export or systematically harvest data from the Service beyond the rate limits we publish;
- misrepresent your identity, your organization, or the brand you are tracking.
5. Customer data and inputs
"Customer Data" means content you submit to the Service (brands, queries, configuration). You retain all rights to your Customer Data. You grant us a limited, non-exclusive license to host, process and transmit Customer Data solely to provide the Service to you.
We do not use Customer Data to train third-party AI models. Where we send prompts to external model providers (such as OpenAI, Anthropic, Google, or Perplexity) on your behalf, we do so only to obtain the answers required to produce your visibility report. Each provider's own terms govern that interaction.
6. Outputs and AI-generated content
Outputs include brand visibility scores, citations, summaries and recommendations. While we invest heavily in quality, AI-generated outputs can be inaccurate, incomplete or out-of-date. You should review outputs before relying on them and not represent them as independently verified facts about third parties.
7. Fees and free beta
The Service is currently offered free of charge during beta. We reserve the right to introduce paid plans on reasonable notice. If you continue to use the Service after pricing takes effect and after accepting an updated plan, fees will apply per the published tier.
8. Intellectual property
We own all rights, title and interest in and to the Service, including software, documentation, trademarks and all derivatives. Except for the limited rights granted in these Terms, nothing transfers ownership to you. Feedback you provide may be used by us without restriction.
9. Third-party services
The Service integrates with third-party AI model providers and infrastructure. We are not responsible for the availability, accuracy or legality of third-party services. Your use of them may be governed by their own terms.
10. Confidentiality
Each party will protect the other party's confidential information with the same degree of care it uses for its own confidential information, and at minimum a reasonable standard of care. Confidential information does not include information that is public, independently developed, or rightfully received from a third party.
11. Termination
You may terminate at any time by deleting your account. We may suspend or terminate your access if you breach these Terms, if we are required to do so by law, or if we discontinue the Service. Upon termination, your right to use the Service ceases. Sections that by their nature should survive termination — including IP, disclaimers, indemnities and limits of liability — will survive.
12. Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED OR ERROR-FREE, OR THAT AI-GENERATED OUTPUTS WILL BE ACCURATE OR COMPLETE.
13. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, NEITHER PARTY WILL BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR FOR ANY LOST PROFITS, REVENUE OR DATA, ARISING OUT OF OR RELATING TO THE SERVICE. OUR TOTAL AGGREGATE LIABILITY ARISING OUT OF OR RELATED TO THESE TERMS WILL NOT EXCEED THE GREATER OF (A) FEES PAID BY YOU TO US IN THE TWELVE MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED EUROS (€100).
14. Indemnification
You will defend, indemnify and hold us harmless from any third-party claim arising out of (i) your Customer Data, (ii) your use of the Service in violation of these Terms, or (iii) your violation of applicable law or third-party rights.
15. Changes to the Terms
We may update these Terms from time to time. If a change is material, we will give you reasonable notice (for example, by email or in-product notice) before it takes effect. Your continued use of the Service after the effective date constitutes acceptance.
16. Governing law
These Terms are governed by the laws of Romania, without regard to conflict-of-law rules. The courts of Bucharest, Romania have exclusive jurisdiction over any dispute arising out of or in connection with these Terms, subject to mandatory consumer-protection laws of your country of residence.
